Terms of Use
Last updated:
These Terms of Use (“Terms”) are an agreement between you and [COMPANY LEGAL NAME — TODO], [ADDRESS — TODO] (“Dearly”, “we”, “us”). They apply to the Dearly app, its widgets and notifications, and the website at dearlytogether.app (the “Service”). Please also read our Privacy Policy, which explains how we handle personal data.
1. Accepting these Terms
By creating an account or using the Service you accept these Terms. If you do not agree, do not use the Service.
2. Eligibility and your account
- You must be at least 18 years old to use Dearly.
- You sign in with Apple, Google or an email code. Keep access to that account secure; you are responsible for activity under your account.
- Provide accurate information and only one account per person. Do not impersonate anyone.
3. The Service and your couple space
Dearly lets two people link their accounts with an invite code and share a private couple space: daily questions, moments (photos and notes), widgets, moods, events, countdowns, nudges and streaks.
- A couple space has exactly two members. Either member can end the link at any time; the space then stays in a read-only archive for 30 days and is then deleted, as described in the Privacy Policy.
- Widgets, notifications and sync depend on your device, operating system and network. We cannot guarantee that a widget refreshes at an exact moment.
- We may change, add or remove features. If we remove a paid feature you are entitled to, we will tell you in advance.
4. Your content
- You own what you create and share (“your content”): answers, notes, photos, captions, moods, events and similar items.
- You give us a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy, process, resize and display your content only to operate the Service for you and your partner (for example to show a moment on your partner’s widget), to keep backups, and to comply with the law. This licence ends when your content is deleted, except for copies in backups until they expire.
- You confirm you have the rights to share your content, including the consent of anyone shown in your photos.
- Content you share is visible to your partner, who may screenshot or save it. You can unsend a moment, but we cannot remove copies your partner has already saved.
5. Acceptable use
You must not use Dearly to share or do any of the following:
- intimate or sexual images of anyone without their consent (non-consensual intimate imagery), or threats to share them;
- any content that sexualises or exploits minors — we report child sexual abuse material to the relevant authorities;
- harassment, threats, stalking, coercive control, intimidation or hate;
- content that promotes violence, self-harm or terrorism;
- illegal content, or content that infringes someone else’s rights;
- spam, malware, scraping, reverse engineering, overloading the Service, abusing invite codes, or trying to access another couple’s data;
- using the Service to monitor someone without their knowledge.
6. Reporting, blocking and enforcement
- You can report a moment, answer or user from inside the app (long-press → Report, or Settings → Support). We review reports and aim to respond within 24 hours.
- You can end the link and block a person from inviting you again at any time.
- If you don’t feel safe, the app’s support screen lists safety resources. In an emergency, call your local emergency number.
- We may remove content, restrict features, or suspend or close accounts that break these Terms or the law, or that put others at risk. Where appropriate and lawful, we will tell you why and how to appeal by emailing [email protected].
7. Dearly Plus subscriptions
7.1 What Plus is
Dearly Plus is an optional paid subscription that adds extra features, such as additional question decks, more widget themes and unlimited countdowns. The daily question, moments, widgets, streaks, countdowns and your full history are available without a subscription. The exact contents of Plus are shown in the app before you buy.
7.2 One plan covers both of you
- When one partner subscribes, Plus is unlocked for both linked accounts. The other partner is never charged. Apple Family Sharing does not apply.
- If both partners subscribe, both subscriptions continue until one is cancelled; we do not cancel or refund either automatically.
- If you end the link, the subscriber keeps Plus and the other partner loses it immediately (no content is lost).
- The subscriber’s Plus can be shared with a new partner at most once every 30 days.
- If the subscriber deletes their account or their subscription ends, the partner loses Plus too.
- A subscription bought on iOS also covers a partner using Android, and vice versa.
7.3 Billing, renewal and trials
- Plus is sold as an auto-renewing monthly or yearly subscription through the App Store or Google Play. The store is the merchant and processes your payment; prices are shown in the app and the store before you confirm and may vary by country.
- Payment is charged to your App Store or Google Play account when you confirm the purchase. The subscription renews automatically at the same price and duration unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- The yearly plan may include a free trial for eligible new subscribers. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription. Any unused part of a trial is forfeited when you buy a subscription.
- If a payment fails, the store may give a grace period during which Plus continues; afterwards Plus is paused until the payment is resolved.
- We will tell you in advance, as required by the store and the law, if a renewal price changes.
7.4 Cancelling and refunds
- Cancel in your device’s subscription settings: on iPhone in Settings → your name → Subscriptions (or the App Store account page); on Android in Google Play → Payments & subscriptions → Subscriptions. Cancelling stops the next renewal; you keep Plus until the end of the period you paid for.
- Deleting the app or your Dearly account does not cancel your subscription.
- Refunds are handled by Apple or Google under their policies. If a refund is granted, Plus ends immediately. Where you have a statutory right of withdrawal (for example in the EU or Türkiye), you agree that the digital service starts immediately after purchase, which may affect that right as permitted by law. [TODO(legal): confirm withdrawal-right wording per market.]
8. Not therapy or professional advice
Dearly is a relationship app for fun and connection. It is not therapy, counselling or medical or psychological advice, and mood check-ins are not a health service. If you need support, please contact a qualified professional.
9. Our intellectual property
The Service, including its software, design, the Dearly name and logo, and our questions and question decks, belongs to Dearly or our licensors and is protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use under these Terms. Open-source components are licensed under their own terms (see Licenses).
10. Third-party services
The Service relies on third parties such as Apple, Google and the app stores. Their terms apply to your use of their services. We are not responsible for third-party services we do not control.
11. Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, we do not promise that it will be uninterrupted, error-free or that content will never be lost — please keep your own copies of important photos. Nothing in these Terms limits rights you have under mandatory consumer law.
12. Limitation of liability
To the extent permitted by law, Dearly is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, and our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim or USD 50 [TODO(legal): confirm cap]. These limits do not apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, fraud, or gross negligence or wilful misconduct where applicable.
13. Ending your use
You can stop using Dearly and delete your account at any time (Settings → Account → Delete account, or https://go.dearlytogether.app/account/delete). We may end or suspend your access as described in section 6. Sections that by their nature should survive (for example 4, 9, 11, 12 and 15) survive termination.
14. Changes to these Terms
We may update these Terms. If a change is material, we will tell you in the app or by email before it takes effect. If you continue to use the Service after that, the new Terms apply; if you do not agree, you can delete your account.
15. Governing law and disputes
[TODO(legal): governing law, venue, consumer carve-outs and, for US users, any arbitration clause and class-action waiver.] If you are a consumer in the EU, UK or Türkiye, you also benefit from the mandatory protections of the law of your country of residence and may bring claims in your local courts or consumer arbitration bodies.
16. Apple App Store additional terms
If you downloaded Dearly from the Apple App Store: these Terms are between you and Dearly, not Apple. Apple has no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation for the app other than to refund the purchase price if the app fails to conform to an applicable warranty. Apple is not responsible for addressing claims relating to the app (including product liability, legal or regulatory compliance, or consumer protection claims) or for third-party intellectual property claims. You confirm that you are not located in a country subject to a US Government embargo and are not on a US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where these Terms are silent, Apple’s Licensed Application End User License Agreement applies.
